அயல்நாட்டு சட்டக் கல்வி நிறுவனங்களை இந்தியாவில் அனுமதிப்பது தொடர்பாக, லோக்சபாவில் கொண்டு வரப்பட உள்ள மசோதாவுக்கு எதிர்ப்பு தெரிவித்து, நாடு முழுவதும் இரண்டு நாட்கள் கோர்ட் புறக்கணிப்பு செய்வதென இந்திய பார் கவுன்சில் அழைப்பு விடுத்தது.

நேற்று புதுச்சேரி நீதிமன்றத்தில் வழக்கறிஞர்கள் பணியைப் புறக்கணித்து, கோர்ட் எதிரில் கண்டன ஆர்ப்பாட்டத்தில் ஈடுபட்டனர். வழக்கறிஞர்கள் சங்கத் தலைவர் குமரன் தலைமை தாங்கினார்.

சங்க பொதுச் செயலாளர் கண்ணன், பொருளாளர் ராஜேந்திரன், இணை செயலாளர்கள், நிர்வாகக் குழு உறுப்பினர்கள் உட்பட பலர் கலந்து கொண்டனர். மத்திய அரசு கொண்டுவரவுள்ள மசோதாவுக்கு எதிர்ப்பு தெரிவித்து கோஷம் எழுப்பினர். சட்ட மசோதாவின் நகலைத் தீ வைத்து எரித்தனர்.

Boycott hits court proceedings

BANGALORE, July 12, 2012

Proceedings in the Karnataka High Court, city civil and sessions courts, metropolitan magistrate courts and other courts in the city were affected on Wednesday as a large number of advocates abstained from courts as part of a nationwide strike.

The Bar Council of India, the apex body of advocates, had given the call for boycotting court proceedings on July 11 and 12 to oppose the proposed Higher Education and Research Bill, 2011, which purportedly would take away the existing autonomy of the council to regulate legal education.

In the High Court, a majority of cases listed for hearing on Wednesday were adjourned. In some cases, the litigants themselves appeared before the court to take adjournments as per the instruction from their advocates.

However, in some cases involving high profile persons and other cases involving urgency, advocates participated in the proceedings.

Lawyers' stir hits work in AP High Court

The work in AP High Court came to halt on Wednesday as advocates abstained from work as per the call given by the Bar Council of India. The cases were adjourned by the judges. The advocate community is protesting the proposal made by the Union of India to take out the subject of legal education from the purview of Bar Council of India. 

The proposal to dilute the disciplinary powers of the Bar Council is also being opposed. Various advocate organisations including Nyayavadi Parishad, All India Lawyers Union, and Indian Lawyers Association supported this call. The members of AP Bar Council are coordinating the two- day agitation throughout the State.

Delhi lawyers abstain from appearing in courts

NEW DELHI, July 12, 2012

Lawyers abstained from appearing in Delhi district courts on Wednesday in response to the Bar Council of India's call to oppose the proposed Higher Education and Research Bill on July 11 and 12.

Lawyers at all district court complexes - Patiala House, Tis Hazari, Karkardooma, Dwarka, Saket and Rohini – refrained from appearing in courtrooms.

The Coordination Committee of Delhi Bar Associations chairperson, R. N. Vats, said a "complete strike" was observed in all the district courts and quasi-judicial bodies in the Capital.

He said that litigants were not affected by the strike as the Bar Council had given the call to protest in early-June and so lawyers and judicial officers were mindful of the strike on these two days when listing matters for the next date of hearing.

Mr. Vats said that when legal educational institutions were functioning in a proper manner, there was no need to snatch away the Bar Council's powers.

He said the Delhi High Court functioned on Wednesday owing to the full-court reference as there was a "tradition" attached to this, but on Thursday all lawyers would abstain from appearing in court.

Tis Hazari Bar Association secretary Nitin Ahlawat said all lawyers cooperated with the protest call and that no proceedings were conducted in any of the Tis Hazari courts.

"We did not have to ask anyone to stop working today. All lawyers are opposed to the HER Bill. The workload was lesser today than usual because we were aware of the strike in advance and had requested judicial officers not to list cases for Wednesday and Thursday," Mr. Ahlawat said.

The only matters heard today were bail hearings and that too only proxy counsel attended, he added.

Advocates boycotted courts in the city and nine other taluk centres on Wednesday to oppose the National Law School Bill, 2011 and four other Bills proposed by the Centre.

The advocates boycotted work in response to a call given by the Bar Council of India, which has been opposing the National Law Schools Bill; the Foreign Educational Institutions (Regulation of Entry and Operations) Bill, 2010; the Higher Education and Research Bill, 2011; and the National Accreditation Regulatory Authority for Higher Educational Institutions Bill, 2010; besides the Motor Vehicles Amendment Bill.

Members of the Belgaum Bar Association took out a procession from Rani Chennamma Circle and shouted slogans against the Centre.

Later, they staged a dharna outside the Deputy Commissioner's office and submitted a memorandum to the government.

Mr. Mulwadmath said the advocates would boycott courts on Thursday as well. Demonstrations would be organised in all taluk headquarters.

Opposed

Dharwad Staff Correspondent reports: The work at all courts came to a halt here on Wednesday as lawyers boycotted work in response to a call given by Bar Council of India opposing the Higher Education and Research Bill proposed by the Centre.

The boycott will continue on Thursday as well.

The advocates took out a procession from the district court to the Deputy Commissioner's office, and submitted a memorandum addressed to the President and the Prime Minister.

"The Bill will take away the autonomy given to the BCI to regulate legal profession in the country," said Dharwad Bar Association president V.D. Kamareddy.

The government by introducing the Bill was trying to undermine the authority of elected bodies of advocates and impose its supremacy over it, he asserted.

Lawyers strike work over higher education bill

CUTTACK: Judicial activities in Orissa high court and several lower courts were affected on Wednesday as lawyers abstained from work in response to the two day strike called by Bar Council of India to oppose the proposed Higher Education and Research (HER) Bill.

Lawyers gathered in front of the various courts and raised slogans against the bill proposed by Union HRD minister Kapil Sibal. The Bar council of India (BCI) has been strongly opposing the bill which seeks to regulate the legal education system in the country. Lawyers alleged that the bill will harm the autonomy of BCI and will usurp its powers.

The agitating lawyers also burned effigy of the HRD minister to express their anger. "The proposed legislation is undemocratic. It would curtail powers of lawyer's apex body .By bringing the Bill, the union Government is attempting to take absolute control of the legal education and services," said Gopal Mohanty, chairman of state bar council.

Along with laywers of Orissa high court , members of 147 bar associations across the state participated in the strike.The Bar Council of India regulates the legal education in the country, but the proposed Bill keeps the council out of ambit of legal education.

"By introducing the Higher Education and Research Bill, the government is trying to make the Bar council of India defunct,"alleged P.K Mishra, another agitating lawyer. The strike will continue on Thursday also.

Along with HER Bill, the lawyers' bodies have expressed their opposition against other draft legislations like the National Law School Bill and the Educational Tribunals Bill, 2012 also.

As part of the statewide agitation called by Bar Council of India (BCI), the advocates in Ganjam district launched their two-day ceasework agitation from Wednesday. Several advocates of the Ganjam Bar Association in Berhampur went on a procession and raised slogans against the proposed Bill and also Sibal. They also burnt an effigy of the minister.

The government on Wednesday tabled the Higher Education and Research Bill, 2011 in the Rajya Sabha that seeks to establish the National Commission on Higher Education and Research (NCHER), an overarching regulatory body for university education including vocational, technical, professional and medical education.

The existing regulatory bodies including the University Grants Commission and the All India Council for Technical Education would subsequently be scrapped. While there is no provision for protecting the chairperson or members of the UGC once the Bill is enacted, the services of officers and employees of the existing regulators would be saved. The Ministry of Human Resource Development has already started the process of selection of UGC chairperson but now there appears to be uncertainty over it now as there would not be many takers for the post.

The Bill seeks to promote autonomy of higher education and innovation and to provide for comprehensive and integrated growth of higher education and research keeping in view the global standards of educational and research practices, for which it will establish the National Commission for Higher Education and Research.

The NCHER will facilitate determination, coordination, maintenance and continued enhancement of standards of higher education and research other than agricultural education and matters pertaining to minimum standard of medical education as are the subject of proposed National Commission on Human Resources in Health (NCHRH).

The NCHRH Bill, 2011 piloted by the Ministry of Health and Family Welfare was tabled in the Rajya Sabha last week. The Commission will consist of a chairperson and six members, one of whom will be the chairperson of the National Commission for Human Resources for Health, who will be appointed by the President on the recommendations of a search-cum-selection committee headed by the Prime Minister with the Lok Sabha Speaker, the Leader of Opposition in the Lok Sabha and the Ministers in charge of medical education and higher education.

The Commission will have powers to take all measures necessary to spearhead the transformative changes in higher education. It will frame regulations and promote autonomy for institutional accountability, promote joint and cross-disciplinary programmes between and among institutions of higher education, to promote development of a curriculum framework with specific reference to new or emerging or inter-disciplinary fields of knowledge and to promote synergy of research in universities and higher educational institutions and with other research agencies.

The legislative proposal provides for the establishment of a General Council, which is proposed to be a representative body with advisory and recommendatory functions, in addition to the powers to approve the regulations framed by the Commission. The Council will have, in addition to chairperson and members of the Commission, the heads of professional bodies, research councils and experts in all sectoral areas of higher education.

Participation of States is being ensured through representation in the General Council. The existing regulators had no representation from the States and the NCHER draft was revised to accommodate States in the General Council. States have also been exempted from seeking prior approval of the NCHER before establishing new universities.

The Board for Research promotion and Innovation will formulate research and innovation policy for sustained global competitiveness, promote transformative and multi-disciplinary research in higher educational institutions, and facilitate the modernisation of research infrastructure in higher educational institutions. The powers and functions of the Board have been synergised with functions of the proposed NCHRH by including two members nominated by the NCHRH in the Board.

The proposed law also has provisions for the establishment of a Higher Education Financial Services Corporation that will disburse grants to universities and higher educational institutions.

மத்திய அரசின் உயர் கல்வி மற்றும் ஆராய்ச்சி மசோதாவைக் கைவிட வலியுறுத்தி நாடு தழுவிய அளவில் நடைபெற்ற நீதிமன்றப் புறக்கணிப்பு போராட்டத்தின் ஒரு பகுதியாக

புது தில்லி, ஜூலை 11: மத்திய மனித ஆற்றல் மேம்பாட்டு அமைச்சகம் கொண்டு வர உள்ள உயர் கல்வி மசோதாவில் (2011) இருந்து சட்டக் கல்வி, வழக்குரைஞர்கள் சட்டம் ஆகிய அம்சங்களை நீக்க வலியுறுத்தி நாடு முழுவதும் வழக்குரைஞர்கள் புதன்கிழமை நீதிமன்றப் பணிகளைப் புறக்கணித்தனர்.

நாடு முழுவதும் நடைபெற்ற இந்தப் போராட்டத்தில் சுமார் 17 லட்சம் வழக்குரைஞர்கள் பங்கேற்று தங்கள் எதிர்ப்பைத் தெரிவித்ததாக தகவல்கள் தெரிவிக்கின்றன. வழக்குரைஞர்கள் நீதிமன்ற புறக்கணிப்புப் போராட்டம் நடைபெற்ற போதும், உச்ச நீதிமன்றம், தில்லி உயர் நீதிமன்றம் ஆகியவற்றில் பணிகளுள் பாதிக்கப்படவில்லை. எனினும் தில்லியில் தீஸ் ஹஸாரி, ரோஹிணி, துவாரகா, சாகேத், கர்கர்டூமா, பாட்டியாலா ஆகிய 6 மாவட்ட நீதிமன்றப் பணிகள் பாதிக்கப்பட்டன.

மும்பை, அலாகாபாத், கொல்கத்தா, பெங்களூர், சென்னை உள்ளிட்ட இடங்களிலும் வழக்குரைஞர்கள் நீதிமன்ற போராட்டத்தில் ஈடுபட்டனர். முன்னதாக, புதன்கிழமை காலையில் நீதிமன்றம் கூடியதும் வழக்குரைஞர்கள் நீதிமன்றத்துக்கு வெளியே போராட்டங்கள் நடத்தினர். 

முக்கிய வழக்குகள்

தில்லி பாட்டியாலா சிபிஐ நீதிமன்றத்தில் நடைபெற்று வரும் "2 ஜி அலைக்கற்றை' தொடர்பான வழக்கு விசாரணையும், காமன்வெல்த் போட்டி ஊழல் வழக்கின் விசாரணையும் வழக்குரைஞர்கள் புறக்கணிப்புப் போராட்டத்தால் ஒத்திவைக்கப்பட்டன. சில நீதிமன்றங்களில் வழக்கில் ஆஜராகும் வழக்குரைஞருக்குப் பதிலாக அவர்களது ஜூனியர் வழக்குரைஞர்கள் ஆஜராகி வழக்கின் விசாரணைக்கு மறுதேதி தருமாறு நீதிபதியிடம் வேண்டுகோள் வைத்தனர். உச்ச நீதிமன்றத்துக்கு எதிரே உள்ள இந்திய பார் கவுன்சில் அலுவலகத்தின் வெளியே வழக்குரைஞர்கள் போராட்டத்தில் ஈடுபட்டனர். இதில் பங்கேற்ற இந்திய பார் கவுன்சிலின் உறுப்பினரும், ஒருங்கிணைப்பாளருமான எஸ்.பிரபாகரன் கூறியது:

சட்டக் கல்லூரிகள் இந்திய பார் கவுன்சிலின் கட்டுப்பாட்டின் கீழ் நீண்ட காலமாக செயல்பட்டு வருகின்றன. தற்போது, மத்திய மனித ஆற்றல் மேம்பாட்டுத் துறை அமைச்சகம் கொண்டு வர உள்ள மசோதாவால் நாடு முழுவதும் உள்ள 950 சட்டக் கல்லூரிகள் பாதிக்கப்படும். இது மாநில சுயாட்சிக் கொள்கைக்கும், இந்திய அரசமைப்பு சட்டத்துக்கும் எதிரானது. இந்த முடிவை அரசு திரும்பப் பெற வேண்டும் என்று அமைச்சர் கபில் சிபலிடம் இந்திய பார் கவுன்சில் நிர்வாகிகள் மூன்று முறை நேரில் சந்தித்துப் பேச்சுவார்த்தை நடத்தினர்.

பிரச்னைக்குத் தீர்வு காணப்படும் என்று அவர் உறுதி அளித்தார். ஆனால், இது வரை எந்த நடவடிக்கையும் எடுக்கப்படவில்லை. புதன்கிழமை நடைபெற்ற போராட்டத்தில் நாடு முழுவதும் 17 லட்சம் வழக்குரைஞர்கள் பங்கேற்றனர். இந்த புறக்கணிப்புப் போராட்டம் வியாழக்கிழமையும் நடைபெறும். இந்தப் பிரச்னைக்குத் தீர்வு காண குடியரசுத் தலைவர் பிரதிபா பாட்டீல், பிரதமர் மன்மோகன் சிங், மத்திய சட்டத் துறை அமைச்சர் சல்மான் குர்ஷீத் ஆகியோருக்கு இந்திய பார் கவுன்சில் கடிதம் அனுப்பியுள்ளது.

எங்கள் கோரிக்கைகளை நிறைவேற்றவில்லை என்றால் ஆகஸ்ட் மாதம் நாடாளுமன்றத்தை நோக்கிப் பேரணி நடத்தப்படும். இதில் நாடு முழுவதும் இருந்து சுமார் 10 லட்சம் வழக்குரைஞர்கள் பங்கேற்பார்கள் என்று பிரபாகரன் கூறினார்.

தமிழகத்தில்.. தமிழகத்தில் சென்னை உயர் நீதிமன்றத்திலும், பிற மாவட்டங்களிலும் நீதிமன்றங்களைப் புறக்கணித்து வழக்குரைஞர்கள் போராட்டத்தில் ஈடுபட்டனர். இதனால் உயர் நீதிமன்றத்திலும், பிற நீதிமன்றங்களிலும் பணிகள் பாதிக்கப்பட்டன. வழக்குரைஞர்கள் ஆஜராகாததால் பெரும்பாலான வழக்குகள் வேறு தேதிக்கு ஒத்திவைக்கப்பட்டன. வழக்குரைஞர்களின் போராட்டம் இரண்டாவது நாளாக வியாழக்கிழமையும் தொடர்ந்து நடைபெறுகிறது.
