'Excess salary paid can't be recovered'

CHENNAI: Salary paid in excess to a government servant cannot be recovered at a later stage, the Madras High Court has observed.

Justice N Kirubakaran said that the recovery of excess salary could not be made by refixation, because the original fixation was done by the authorities concerned and it was not due to the fault of the petitioner.

Accepting the submissions of advocate RY George Williams on these lines, the judge quashed the orders of and allowed a batch of writ petitions from those who worked in the TN Government Press.
