NEW DELHI: The Delhi High Court has ruled that NRIs can represent themselves through their lawyers in family courts here for finalising divorce through mutual consent.
The ruling came on a revision petition filed by U.K.-based Vinay Jude Dias against him being summoned by a family court on a suit filed jointly by him and his wife seeking divorce through mutual consent. His pleaded that he be allowed to represent himself through his counsel for confirmation of his consent for the divorce.
“An attorney is competent to act on behalf of his client on the basis of power of attorney executed by him,” Justice S.N. Dhingra said.
“When the parties are living far away from the jurisdiction of courts, they, after filing their affidavits, can appoint attorneys to act on their behalf to dissolve their marriages,” the Court said.
