CHENNAI: The Madras High Court on Wednesday dismissed a batch of writ petitions challenging collection of toll from vehicles passing through New and Old Bridges, or Aathu Palam, in Coimbatore.
Justice S.J. Mukhopadhaya and Justice K. Suguna dismissed the petitions, holding that Section 8-A(1) of the National Highway Act empowered the Centre to enter into an agreement with any private person for development and maintenance of whole or any part of the national highway. Such a person “was entitled to collect and retain the fees at such a rate for services or benefits rendered by him, as the Central Government may by notification specify.”
The petitioners sought to declare Section 8-A unconstitutional and wanted the court to forbear Larsen and Toubro Limited, which executed the project, from collecting the toll from vehicles passing through the bridges located on National Highway-47.
