Madurai : (PTI) Water connection to a house could be disconnected with issuing any notice if the consumer was found illegally drawing water, the Madurai Bench of Madras High Court has ruled.
Justice M Jeyapaul said the principle of natural justice would not apply in such a case as it involved violation of government's standing order prohibiting suction of water from civic pipelines.
C Sakthivel, a petitioner from Kovilpatti contended that the municipality had without issuing a notice disconnected water supply to his house, seized the electric pump and ordered him to pay a fine of Rs 7,000 to restore the supply.
The court said issuing notice and receiving explanation was a lengthy process.
"The officials cannot close their eyes until the enquiry is concluded. By that time, the violators would have caused irreparable damaged to the interest of the public who were entitled to get the water," the judge said.
The officials had seen illegal tapping of water and he had no other alternative except to seize the motor, the court said.
