Chennai, August 23: The Madras High Court has upheld the election of AIADMK candidate C Chinnasamy from Marungapuri constituency in Tiruchirapalli district during the May 2006 Assembly elections.
Dismissing the election petition filed by defeated DMK candidate A Rokkaiah Malik, Justice C Nagappan said yesterday the averments in the petition are vague and general and are not based on any facts or documents and they reflect only the opinion of the petitioner.
“The petitioner has not pleaded either material facts or violation of any specific provisions of law to make out a cause of action and a triable issue and no allegation of corrupt practice as set out in Section 123 of the Representation of the People Act has been pleaded," the judge observed.
The judge said the petition read as a whole does not disclose any cause of action and triable issue and the same has to be rejected. (Agencies)
